Terms and Conditions

These Terms and Conditions ("Terms") apply to the Pebble Reef app, website, support, and related services provided by Pebble Reef by Devon Allary ("Pebble Reef", "we", "us", or "our"). By using Pebble Reef, you agree to these Terms.

App Store terms

Pebble Reef is available through the Apple App Store. Your download and use of the app is also governed by Apple's App Store terms, including Apple's Licensed Application End User License Agreement unless a different agreement is shown by Apple. If these Terms conflict with Apple's required App Store terms, Apple's terms control for App Store downloads, purchases, refunds, and Apple platform services.

Using Pebble Reef

Pebble Reef is licensed for your personal, non-commercial use on Apple devices you own or control, subject to Apple platform rules and these Terms. You may not copy, resell, redistribute, reverse engineer, modify, bypass purchase or entitlement checks, interfere with Pebble Reef services, or use Pebble Reef in a way that violates the law or another person's rights.

Purchases and paid content

The base app may be free, and optional content packs or unlocks may be offered only as Apple App Store in-app purchases. Pebble Reef does not sell digital unlocks through a web checkout. Prices, taxes, billing, payment methods, and refund requests are handled by Apple and may vary by region. Apple's refund eligibility rules apply, subject to any rights you have under applicable consumer law.

Current paid unlocks are non-consumable in-app purchases, not subscriptions. A non-consumable unlock is purchased once and does not expire or decrease through use. Purchases are associated with your Apple Account and can be restored inside Pebble Reef on compatible devices, subject to Apple's App Store and account rules.

Paid content is licensed for use inside Pebble Reef. It is not sold to you, has no cash value, is not redeemable for money or other consideration, and may be subject to platform availability and compatibility.

App content and changes

Pebble Reef may add, change, rebalance, or discontinue features, content, packs, pricing, and services over time. We will not make a non-consumable purchase expire through use, and we will use reasonable efforts to preserve access to purchased content in supported versions of Pebble Reef. Device compatibility, operating-system changes, legal requirements, and the availability of the app or third-party services may still affect access over time.

Website and support

Website content, app previews, screenshots, and support materials are provided for general product information. Availability, pricing, and features shown on the website may change and should be confirmed in the App Store or in the app before purchase.

When you contact support, you agree to provide accurate information and communicate respectfully. We may decline support requests that are abusive, fraudulent, unrelated to Pebble Reef, or impossible for us to verify.

Ownership

Pebble Reef, including its artwork, designs, animations, text, code, names, logos, and other materials, is owned by Devon Allary or its licensors and is protected by copyright, trademark, and other laws. These Terms do not transfer ownership of Pebble Reef to you.

If you send feedback or suggestions, you allow us to use them without restriction or compensation, while you retain any rights you already have in your own materials.

Third-party services

Pebble Reef may rely on third-party services such as Apple App Store, StoreKit, Apple platform services, hosting providers, and support tools. Those services may have their own terms and privacy policies. We are not responsible for third-party services we do not control.

Privacy

Our Privacy Policy explains how Pebble Reef handles information. By using Pebble Reef, you acknowledge that policy.

No warranties

Pebble Reef is provided "as is" and "as available." To the maximum extent allowed by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, and error-free performance. Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded. Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.

Limitation of liability

To the maximum extent allowed by law, Pebble Reef will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, business interruption, device issues, or inability to use the app. To the maximum extent allowed by law, our total liability for claims related to Pebble Reef is limited to the greater of the amount you paid for Pebble Reef content in the 12 months before the claim or USD $50. Nothing in these Terms limits liability or remedies that cannot lawfully be limited, including mandatory consumer rights. Some jurisdictions do not allow certain liability limits, so parts of this section may not apply to you.

Termination

You may stop using Pebble Reef at any time. We may suspend or end access to services we control if you violate these Terms, create risk, or misuse Pebble Reef. Sections about ownership, paid content, disclaimers, liability limits, and legal effect continue after termination where applicable.

Changes to these Terms

We may update these Terms as Pebble Reef changes. The updated Terms will be posted on this page with a new last updated date and will apply prospectively from that date. If a change materially affects your rights, we will provide any additional notice required by law. Changes do not reduce rights in a completed purchase where applicable law or Apple's terms prohibit that result.
